Privacy Policy

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), SmartSage SRL informs users of the Best Beach Today Ibiza & Formentera application (hereinafter, the Application), about the processing of personal data voluntarily provided during the registration, access, and use of the service.

1. IDENTIFICATION OF THE DATA CONTROLLER
SmartSage SRL, with VAT ID B70744792 and registered address for notifications at Calle San Jaime, 118, 2º A, 07840, Santa Eulalia del Río (Illes Balears), is the data controller responsible for the processing of the personal data provided by users of the Application (hereinafter, the User/s).

2. PURPOSE OF DATA PROCESSING
To register, access, and subsequently use the Application, the User must voluntarily provide personal data (primarily identifying and contact data), which will be stored in automated files owned by SmartSage SRL.

The collection, storage, modification, structuring, and, where applicable, deletion of the data provided by Users constitute data processing operations carried out by the Controller with the purpose of ensuring the proper functioning of the Application, maintaining the service and/or commercial relationship with the User, and managing, administering, informing, providing, and improving the service.

The personal data provided by the User — especially name, surname, phone number, account number, and email — may also be used to send newsletters and commercial communications related to promotions and/or advertising for the Application, provided the User has given prior express consent to receive such electronic communications.

3. LEGAL BASIS
The User’s data is processed based on the following legal grounds:

• The request for information and/or the contracting of the Application’s services, whose terms and conditions will always be made available to the User for prior and explicit acceptance.

• The User’s free, specific, informed, and unequivocal consent, made available through this Privacy Policy, which must be accepted by a declaration or clear affirmative action, such as checking an appropriate box.

If the User fails to provide their data to SmartSage SRL, or provides incorrect or incomplete data, it will not be possible to use the Application.

4. RETENTION OF PERSONAL DATA
The personal data provided by the User will be retained in the systems and databases of the Data Controller as long as the User continues using the Application and does not request their deletion.

To cover any potential liabilities arising from processing, data will be kept for a minimum period of five years.

5. RECIPIENTS
Data will not be disclosed to any third parties outside of SmartSage SRL, except where legally required or where the User has provided prior consent.

However, SmartSage SRL may grant access to or transfer personal data to third-party service providers under data processing agreements, who will only access such information to provide services on behalf of and for the Controller.

Personal data may be shared with third parties to carry out specific tasks or services requested by the User.

Certain data may be stored via Google Analytics, so we refer to Google’s Privacy Policy, as Google collects and processes such data.

Similarly, the Application may use Google Maps, which may access your location (if permitted) in order to provide more specific directions and/or routes to a destination. In this regard, please refer to the Google Maps Privacy Policy for details on how such data is used and processed.

6. DATA RETENTION (HOSTING PROVIDER)
SmartSage SRL informs the User that, as a data hosting service provider and pursuant to Spanish Law 34/2002 of July 11 (LSSI), it retains, for a maximum of 12 months, only the essential information required to identify the origin of the hosted data and the time when the service was initiated.

This retention does not affect the confidentiality of communications and may only be used in criminal investigations or for public security, made available to courts or the competent ministry if legally requested.

Disclosure of data to law enforcement agencies will be made under data protection laws and with full respect for such legislation.

7. PROTECTION OF HOSTED INFORMATION
The Controller adopts necessary measures to guarantee the security, integrity, and confidentiality of data in accordance with the GDPR (specific security measures should be confirmed with the system administrator).

Although the Controller performs backups of the content hosted on its servers, it is not responsible for accidental loss or deletion of data by Users. Likewise, it does not guarantee full recovery of deleted data, as such data may have been deleted or altered since the last backup.

Services provided through the Application, unless explicitly stated otherwise, do not include recovery of data from backups in cases where the data loss is caused by the User. In such cases, a fee may apply depending on the complexity and volume of the recovery, subject to prior user acceptance. Data recovery is only included in the service cost when the loss is due to a cause attributable to the Controller.

8. EXERCISING RIGHTS
SmartSage SRL informs the User of their rights to access, rectification, restriction, erasure, objection, and data portability, which may be exercised by sending a request to: bestbeachtoday@smartsage.es

The User also has the right to revoke previously given consent and to file complaints with the Spanish Data Protection Agency (AEPD).

9. COMMERCIAL COMMUNICATIONS VIA ELECTRONIC MEANS
In accordance with the LSSI (Law on Information Society Services), SmartSage SRL will not send advertising or promotional communications via email or other equivalent electronic means without prior request or express authorization from the recipients.

However, in the case of Users with a prior contractual, legal, or service relationship, the Controller is authorized to send commercial communications related to similar products or services originally contracted by the User.
